GENERAL

1.1. This document is an electronic record generated by a computer system, and as such, does not require any physical or digital signatures.

1.2. This document provides the rules and regulations, privacy policy, and Terms of Use for access to or usage of Dima.ph or the Dima application.

1.3. The domain name Dima.ph (hereinafter referred to as ‘Website’) is owned by Dima Health Technologies Inc. (hereinafter referred to as ‘Company’).

1.4. For the purposes of these Terms of Service, wherever the context requires, the terms ‘You’/ ‘User’ shall refer to any natural or legal person who has downloaded and installed the Dima Mobile Application (hereinafter referred to as ‘App’) and provided Registration Data while registering on the App or by simply visiting the Website by entering the domain name in any internet browser. If you are entering into these Terms on behalf of an entity, you represent and warrant that you have the power to bind that entity and agree to these Terms on its behalf. Any services provided by the Website/App that do not require registration do not absolve you of the contractual relationship established by this Agreement.

1.4.1. By visiting the Website, you are bound by these Terms of Service and any other binding documents as decided by the Company. You are requested to read them carefully before accepting and continuing to use the App.

1.4.2. The term ‘We’/ ‘Us’/ ‘Our’ shall mean Dima Health Technologies Inc. and our mobile application Dima. Your use of the App is governed solely by these Terms of Service and any other terms or policies published by Us. Continuing beyond the home page of the Website or downloading the App signifies that you have read and agreed to all terms and conditions.

1.4.3. You will be subject to the rules, guidelines, policies, terms, and conditions as applicable to any service provided by this App, and they shall be considered part of this Terms of Service. We hold the sole right to modify these Terms of Service without prior permission or informing you.

1.4.4. This relationship with Us creates a duty for you to periodically check the terms and stay updated with its requirements. If you continue to use the Website/App following changes, this is deemed as unequivocal consent to the amended policies. As long as you comply with these Terms, we grant you a personal, non-exclusive, non-transferable, limited privilege to enter and use the App.

1.4.5. Through the Website, Users can select a specialty (e.g., Men's Health). After that, the User can either see a Medical Professional immediately or schedule an appointment for a later time. A Medical Professional will be allocated to the User based on availability.

1.4.6. We are not liable for any records, data, pictures, or documents submitted by other means such as personal email, mobile, SMS, or any messaging platform.

1.4.7. This App/Website is also aimed at assisting Medical Professionals to provide services to patients who have registered on the App/Website. Medical Professionals must be verified by providing proper documentation, which shall be authenticated by the Company before joining the App/Website.

1.4.8. By accepting these Terms, you also agree to be bound by other Company Policies and rules, including the Privacy Policy, which may be amended from time to time.


MEMBERSHIP/USAGE

2.1. The membership/usage of the Website/App is restricted to those above 18 years of age or such persons who have attained 'majority' under the laws of the Philippines or emancipated minors, with legal parental or guardian consent, or those able to enter into these Terms and comply with them.

2.2. You are solely responsible for maintaining the confidentiality of your username and password. Any activity under your account will be deemed to have been done by you. If we discover that you have provided false information, we reserve the right to suspend or terminate your account.

2.3. You understand that the App downloaded onto your phone or tablet is owned by Us, and we may automatically upgrade the App. These Terms shall apply to any upgrades.


COMMUNICATIONS AND INFORMATION SHARING

3.1. By using the Website/App, you consent to receiving calls, auto-dialled, and/or pre-recorded messages from Us at any time using the telephone number you provided, in accordance with the Privacy Policy.

3.2. You consent to receiving communications (e.g., SMS, emails) from Us at any time we deem fit, including clarification calls and marketing communications. To stop receiving such communications, you may email us at hello@dima.ph.

3.3. You may also be contacted by Service Providers with whom we have entered into a contract to fulfill Our obligations. Contact will be made in pursuit of the respective contract agreements and/or policies.

3.4. The sharing of your information is governed by the Privacy Policy. We will not share your personal contact information with third parties not connected with the Website/App or its services unless required for service provision or as outlined in the Privacy Policy.


PAYMENT

4.1. The installation and use of this Website/App is free of charge for some services. However, you understand and accept that these free services may be modified at any time at the discretion of the Company.

4.2. If you use paid services such as consultation with a Medical Professional or purchase medication, you will be required to pay for the services as indicated on the payment page at the time of usage.

4.3. In this section, ‘Buyer’ refers to Users choosing to use the services offered on the Website/App, and ‘Seller’ refers to Us/Website/Company.

4.4. All prices listed for payable services on the Website/App are subject to change, and we reserve the right to modify prices without prior notice. Prescription products cannot be used with discount codes, promotions, and are not refundable or exchangeable.


THIRD PARTY INFORMATION

5.1. The content on the Website/App, including text, graphics, user interfaces, photos, trademarks, logos, sounds, and design documents, is owned by Us.

5.2. The Website/App may contain links to third-party websites. We have no control over third-party content and are merely intermediaries.

5.3. We are not liable for any loss caused by third-party content that infringes on intellectual property rights.


USER CONTENT

6.1. Any content you upload or post on the Website/App becomes Our property, and you grant Us worldwide, perpetual, transferable rights in such content for use in promotional or other purposes, consistent with Our Privacy Policy.

6.2. We have the right to verify the truthfulness of the content you post, including time, place, and nature.

6.3. We reserve the right to remove or edit content that violates these Terms.


USER OBLIGATIONS

7.1. You agree not to cut, copy, distribute, or modify the content of the Website/App unless expressly allowed.

7.2. Unauthorized use of the Website/App, including attempts to reverse engineer or replicate the service, is prohibited.


CANCELLATIONS AND REFUNDS

8.1. Once an appointment is confirmed, no refunds will be issued if the User cancels. Similarly, if medication is prescribed, no refund will be issued if the User cancels after order confirmation.

8.2. In certain cases, at the Company's discretion, refunds may be issued if the Medical Professional becomes unavailable or no suitable medication is available.


LOCATION

9.1. Our services, including chat, phone call, video call, and medication delivery, are available only in the Philippines.


DISCLAIMERS

10.1. Dima is a platform that connects Users with Medical Professionals, and we are not liable for any deficiencies, misconduct, or injury caused by the Medical Professional.

10.2. The Medical Professionals are independent and responsible for their services. Dima does not practice medicine and does not interfere with the practice of medical professionals.


COMPLIANCE WITH LAWS

11.1. Users must comply with all applicable laws of the Philippines when using the Website/App.


DISCLAIMER OF WARRANTIES AND LIABILITIES

12.1. The Website/App is provided "as is" without any warranties, including those related to availability, reliability, and security.


INDEMNIFICATION AND LIMITATION OF LIABILITY

13.1. You agree to indemnify Dima Health Technologies Inc. against any losses, claims, or damages arising from a breach of these Terms.


SEVERABILITY

14.1. If a provision of these Terms is deemed unlawful or unenforceable, the remaining provisions will remain in effect.


DISPUTE RESOLUTION

17.1. These Terms will be governed by the laws of the Philippines. Any disputes shall be resolved under Philippine jurisdiction.


MISCELLANEOUS

18.1. We reserve the right to change these Terms at any time and notify users by updating this document. Continued use of the Website/App constitutes acceptance of the updated Terms.

How long will delivery take?

If your product requires a prescription, you will be guided to fill out a short medical form. Our partner physicians will review it and issue you a free prescription if everything is in order.
Do I need to book an online consultation with your doctors to get a prescription?
Nope! Our telemedicine consultations are available just in case you’d like to talk to a specialist. Each prescription product corresponds with a quick health questionnaire. As we mentioned earlier, our doctors will review your answers and write you a prescription for free!
Can I use an existing prescription?
Absolutely. If you already have a valid prescription, simply upload a photo of it when prompted during your order.
What happens if my prescription request is rejected?
Don’t worry if our doctors did not approve your order. Your order will be fully refunded.

Online Consultations

What specialists do you have?
Dima’s telemedicine platform is steadily growing. Right now, we have OB-GYNs, urologists, and dermatologists at your service for telemedicine consultation.
How do I book a consultation?
Head over to Dima’s booking page and select the specialization you have in mind. Pick your preferred doctor and schedule, and then confirm your choice. Make sure to book your telemedicine consultation at least 3 hours before your desired schedule so that our doctors have time to accommodate you!
